Lanigan Estates is a local independent estate agent that aims to provide a personal service to all tenants that you would not get from a traditional estate agency. We are on call 24/7 for any issues that may arise, and are very happy to come and meet with you during evenings and weekends by appointment to solve any problems that need to be discussed. Like renting a flat from a private landlord, but with great service and the knowledge that things will run smoothly.

As of the 1st June 2019 The Tenant Fees Act 2019 came into force.  This means that many of the fees that used to be charged, are no longer applicable for tenancies starting after the 1st June 2019.  (For tenancies starting prior to this date, tenant fees are applicable until 31st May 2020).

Contract Details

All properties are let on an AST (Assured Short Term) tenancy for periods of one year or more. Generally the tenancy is subject to a six month break clause, with two month’s notice after this period. Tenancies can be renewed after the first contract, or can be taken for a longer period subject to Landlord approval.

The rent is paid monthly in advance via standing order for the term of the tenancy and any term afterwards. Any payments made via cash or cheques will incur a charge of £10 to cover bank charges. Payments from foreign bank accounts may incur extra charges from both sides. Please ensure that your payments include these charges.

Further Details

Change of Tenant

If one person on the contract wishes to change over they may do so subject to Landlord Approval. Lanigan Estates must be informed of all changes wishing to take place as soon as possible. The full rent for the flat must be paid over this period, and the new tenant pass on all required information before moving in and pass required referencing. The new change over must not take place until all procedures are completed and the new tenant approved and and applicable fees/monies paid. There will be a charge of £90.00 inc VAT for the administration work involved and drawing up of a new contract for any tenancies starting prior to the 1st June 2019. Plus the new tenant will be required to undertake a reference at £30.00 inc VAT as detailed above.  For any tenancies starting after the 1st June 2019 please refer to our Permitted Tenant Fees section for further detiails.

Bills

Tenants are responsible for paying all utility bills for the property. These include the following: Council Tax, Water, Electricity, Gas and TV Licence. All properties will have the availability to connect to a BT landline which you will need to do if you would like phone or internet access at the property. This is optional depending on your needs.

When you move into the property all necessary meter readings will be taken. You will need to speak with each company to open and set-up your account for the above bills. Any previous final bills should be forwarded to Lanigan Estates to be finalised.

Deposit Details

For any tenancies starting after the 1st June 2019 will have a 5 weeks deposit taken (6 weeks where the stated rent is above £50,000 per annum) as per the new legislation that has come into force.  All deposits whether held by Lanigan Estates or the Landlord are held under a Tenancy Deposit Protection Scheme.  The scheme used by Lanigan Estates for all deposits held by Lanigan Estates is The Dispute Service (TDS). Maintenance

Any maintenance issues that occur in the properties will be dealt with directly and promptly by ourselves when managed by Lanigan Estates. We use a variety of suppliers for our maintenance to try and ensure issues can be dealt with promptly and in a timely manner.  You can also be secure in the knowledge that the staff are trusted and have good knowledge of your property. The majority of outside contractors that need to be used are fully trusted long term suppliers or will be supervised by a member of staff from Lanigan Estates if required.  It is very important to report maintenance issues in a timely manner so as not to allow the issue to cause further damage.  All issues should be reported, whether the fault of the landlord or tenant. 

Inspections

All flats will undergo 6 monthly inspections, sometimes more regularly if required. This is to ensure that the property is being maintained in the correct manner as per the tenancy agreement. This is not a full inventory inspection, but a general inspection and may pull up issues surrounding cleaning, gardening, general maintenance.  Any issues that arise from this inspection whether the responsibility of the Landlord or the Tenant, will be reported and dealt with promptly by either side. These will then be re-inspected at a later date if required in agreement with both parties.

Updated Tenant Fees

The Tenant Fees Act 2019 came into force on the 1st June 2019.

The below fees are permitted fees that are applicable under the new Tenant Fees Act:

A refundable holding deposit (up to 1 week’s rent).  This will be refunded if the tenancy doesn’t proceed unless you as a prospective tenant provide false or misleading information.

A Default fee may be charged to the Tenant if there is a loss of key/security device for the property.  This will be charged at the cost of the replacement.

A payment to alter the tenancy agreement, when requested by the tenant (up to £50 inc VAT, or reasonable costs incurred if higher.

Payments associated with early termination of the tenancy when requested by the tenant

Interest, at a rate of up to 3% above the Bank of England’s base rate, for late payment of rent (which is more than 14 days overdue), returned payments

Payments to service providers in respect of utilities, communication services, TV licence and council tax
Other payments, permitted under appropriate legislation, including damages.

For Tenancies that started prior to teh 1st June 2019, the below fees are still applicable until 31st May 2020:

£30.00 including VAT per tenant/guarantor for reference fees which we undertake using an independent company. (please note a reference is required for each tenant moving into the property, and if a guarantor is required a reference is also required for each guarantor).

£90.00 including VAT per change of tenant within a current tenancy for the administrative work involved covering all aspects. (50% discount off initial administration fee)  NB: The usual reference fee as detailed above will be required for the new tenant moving into the property.

£90.00 including VAT per contract renewal for the administrative work involved covering all aspects. (50% discount off initial administration fee)

£90-120 including VAT per property for a tenant check-out fee which occurs at the end of the tenancy.  (Variation in price due to size for Studio/1 bedroom, 2 bedroom and up to 3+ bedrooms)
